General Terms and Conditions

This contractual document governs the purchase of products through the website https://www.presstok.com, owned by the company A.B INGENIERIA CIVIL S.L, hereinafter referred to as PRESSTOK.

Acceptance of this document implies that the user:

Has read, understands, and comprehends the contents herein.
Is a person with sufficient capacity to enter into contracts.
Assumes all the obligations set forth herein.

These terms shall have an indefinite validity period and shall apply to all purchases made through the PRESSTOK website.

PRESSTOK informs that the business is responsible for and aware of the current legislation in the countries to which it ships products.

Contracting Procedure

To complete the purchase, the user must freely and voluntarily provide the personal data requested, which will be processed in accordance with current personal data protection regulations, Regulation (EU) 2016/679 of April 27, 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as detailed in the Legal Notice and Privacy Policy of this website.

If the user wishes to create an account, they must select a username and password, agreeing to use them diligently and not make them available to third parties, as well as to inform PRESSTOK of their loss or theft or possible unauthorized access by a third party, so that they may be immediately blocked.

It is hereby informed that in accordance with Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE), the contracting procedure will follow these steps:

1. Ownership Rights

In accordance with the limited rights expressly granted hereby, PRESSTOK reserves all rights, title, and interest relating to the products offered on its website, as well as all relevant intellectual property rights.

2. Competence

The user may not assign, transfer, or transmit the rights, responsibilities, and obligations contracted in the sale.

If any provision of these terms is deemed null or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected in any way.

The user declares to have read, understood, and accepted these General Conditions in their entirety.

3. Force Majeure

Neither party shall be liable for any failure due to force majeure. Fulfillment of the obligation will be postponed until the cessation of the force majeure event.

4. Product Selection

In the “Store” section, the user can view all products available for sale.

Each product page displays its features and prices, including taxes.

5. Product Price

The prices applicable to the products are those in effect at the time the order is placed. These prices will be displayed including VAT, as clearly indicated when selecting the product.

These prices include 72-hour shipping costs for mainland Spain. For the Balearic and Canary Islands, shipping costs are detailed separately after entering the order details and must be expressly accepted by the user.

The company reserves the right to modify prices without prior notice.

6. Payment Method

Products may be paid for using:

Credit or debit card
Cash on delivery

Either payment option may be selected by the user at the time of confirming the sale.

7. Order Protocol

The following procedure has been established for purchases through the PRESSTOK website:

Once the product is selected, the user must click “add to cart.” The product will appear in the cart, where the quantity can be modified or removed, and changes can be saved. Then, the user may “finalize the order.”

The sale can be finalized either with a customer account (if previously registered) or by entering the following details for account creation or one-time use:

Address
Postal Code
City
Province
Phone number
Email address

If the user is already registered, they must provide their username and password.

The user can select the shipping option and view its cost.

Next, the user can choose the payment method.

If paying by credit or debit card, the platform will redirect to the payment gateway, where card details must be entered.

Afterward, as confirmation of the sale, an email will be sent to the user’s provided address, containing the order number and details.

If the user wishes to receive an invoice, it may be requested after receiving the order confirmation email and will be sent in the following days.

8. Product Availability

PRESSTOK informs the user that, on occasion and due to causes beyond control—such as human error, system issues, or simultaneous orders—it is possible that a product may become unavailable after the order has been placed. In such cases, PRESSTOK will contact the user to provide information and seek a solution.

9. Warranty

PRESSTOK guarantees that the products offered for sale function properly and do not contain defects or hidden flaws that would render them dangerous or unsuitable for normal use.

According to Royal Legislative Decree 1/2007, as amended by Law 7/2021:

3 years of legal warranty for new products sold to consumers (as of January 2022).

This warranty covers manufacturing defects and lack of conformity existing at the time of delivery.

For the first 2 years, it is presumed that the defect existed unless proven otherwise by the seller.
From the second to the third year, the consumer can still claim, but must prove that the defect originated at the time of purchase.

The warranty is void in the event of defects or damage caused by external influences, accidents, wear and tear, or misuse.

10. Order Cancellation or Modification

PRESSTOK will accept order cancellations and/or modifications when requested before the order has been shipped. Requests must be sent via email to: ventas@presstok.com

However, the company does not guarantee that changes can be made if the order is already in its final preparation stage, so it is strongly recommended that such changes be communicated as soon as possible.

11. Right of Withdrawal

I. Return Procedure

All products purchased from PRESSTOK may be returned and refunded, provided that the user notifies their intention to return the product(s) within 14 calendar days from the delivery date, in accordance with Article 71 of Law 3/2014 of March 27.

All returns must be communicated to PRESSTOK by contacting customer service via email at ventas@presstok.com, including all personal details and the invoice or order number.

Returns should be made using the same box or bag in which the product was received, in order to protect it. If that is not possible, the user must return the product in a protective box to ensure it reaches the PRESSTOK warehouse in the best possible condition.

Unless the return is due to a product defect, shipping costs are the user’s responsibility.

Return shipping will be at the user’s expense unless it is due to an error in order preparation by the PRESSTOK online sales service.

The user will only be responsible for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics, or functioning.

In other cases, cash-on-delivery returns will not be accepted. If the user simply does not like the product, both the initial and return shipping costs will be borne by the user.

II. Refunds

Product returns will result in a refund equal to the cost of the returned products, minus the shipping service fees.

Only in the event that the delivered product is defective or incorrect will PRESSTOK also refund the corresponding shipping costs to the user.

Partial returns and cancellations will result in partial refunds.

12. Responsibilities

The website operator cannot guarantee uninterrupted or continuous use of the website and/or the electronic platform. Therefore, the website operator does not guarantee and is not responsible for:

I. Uninterrupted availability of the website, or for lack of availability or accessibility.
II. Absence of errors during website use.
III. Absence of viruses or other harmful components on the website or in the system used to download the platform.

However, the website operator declares that all necessary measures have been taken, within the limits of current technology, to ensure proper website functionality and avoid the existence of harmful components for users.

13. Claims

If the user wishes to submit a claim, they must do so by sending an email to ventas@presstok.com, including their personal information, order number (if applicable), and the reason for the claim.

14. Applicable Law and Jurisdiction

These general terms shall be interpreted in accordance with the laws in force in Spain, which shall apply subsidiarily in all matters not expressly provided for.

The contract shall be presumed concluded in Monzón, which shall determine the competent jurisdiction in the event of any disputes that may arise in the future.

For the resolution of any dispute regarding the fulfillment or interpretation of this contract, both parties submit to the Courts and Tribunals of Monzón.
